Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the IMGing.Tools website (the "Service") operated by IMGing.Tools ("us", "we", or "our").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.

1. Description of Service

The Service provides users with tools to optimize and compress various image file formats (including but not limited to SVG, GIF, JPEG, PNG, WebP) by uploading them to our server for temporary processing. The optimized image data is then returned to the user's browser.

2. User Conduct

You agree not to use the Service:

To upload, process, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
To upload or transmit any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
To interfere with or disrupt the Service or servers or networks connected to the Service.
To attempt to gain unauthorized access to the Service, other accounts, computer systems, or networks connected to the Service.
For any purpose that constitutes abuse, including but not limited to generating excessive load or attempting denial-of-service attacks.

3. Intellectual Property

You retain full ownership and all intellectual property rights to the image files you upload to the Service. We do not claim any ownership rights over your content.

The Service itself, including the website design, text, graphics, logos, and software (excluding third-party libraries used), is the property of [Your Name/Company Name, if applicable] and is protected by copyright and other intellectual property laws.

4. File Handling and Storage

As detailed in our Privacy Policy, files uploaded to the Service are stored temporarily solely for processing. We automatically delete the original uploaded file and any temporary optimized files immediately after processing is complete. We do not intend to store your files long-term.

5. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Your use of the Service is at your sole risk.

The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

We do not warrant that:

The Service will function uninterrupted, securely, or be available at any particular time or location.
Any errors or defects will be corrected.
The results of using the Service (e.g., file size reduction, visual quality, animation preservation) will meet your specific requirements or expectations. Optimization results can vary greatly depending on the input file and selected options.
The Service is free of viruses or other harmful components.

6. Limitation of Liability

In no event shall IMGing.Tools, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of or inability to access or use the Service.
Any conduct or content of any third party on the Service.
Any content obtained from the Service (including processed files).
Unauthorized access, use, or alteration of your transmissions or content (including uploaded files during their temporary existence on our server).

Whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

7. Indemnification

You agree to defend, indemnify and hold harmless IMGing.Tools and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms, or c) content you upload to the Service.

8. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, with specific jurisdiction in Bengaluru, Karnataka, India, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

10. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide notice prior to any new terms taking effect (e.g., by posting on the website). What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
